Digital Millennium Copyright Act (DMCA) Notice
ASK.ME Games respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), the text of which may be found on the U.S. Copyright Office website at www.copyright.gov, we will respond expeditiously to claims of copyright infringement committed using our website that are reported to us.
How to File a DMCA Takedown Notice
If you believe that content available on or through our website infringes one or more of your copyrights, please notify us by submitting a written DMCA Notice containing the following information:
1. Physical or Electronic Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive copyright right that is allegedly infringed.
2. Identification of Copyrighted Work: Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
3. Identification of Infringing Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material. Providing the specific URL(s) of the pages containing the allegedly infringing material is the most effective way to help us locate content quickly.
4. Contact Information: Information reasonably sufficient to permit us to contact the complaining party, including your name, physical address, email address, telephone number, and any other relevant contact details.
5. Good Faith Statement: A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6. Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Filing a Counter-Notice
If you believe your content was removed or disabled by mistake or misidentification, you may file a counter-notification with us. Your counter-notice must include:
Your physical or electronic signature; identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed; a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification; your name, physical address, telephone number, and email address; a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located; and a statement that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, ASK.ME Games has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, access for users or account holders who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to our website or terminate any user who infringes any intellectual property rights of others, whether or not there is any repeat infringement.
